There is no substitute for qualified legal advice. If you’re currently undergoing a divorce and you want to make sure that you’re doing so without breaking the laws of your state. Meaning you should work with divorce lawyers who have previously dealt with cases like yours as soon as possible.
As much as you might initially deny it, all the constant bickering between you and your spouse had reached to unbearable heights where both of you can’t resolve your differences at all. As a result, you decided to end your marriage with your spouse by filing for divorce. But cutting your marital ties doesn’t mean that you can slack off as your now ex-spouse can get back at you anytime. You would, therefore, want to take note of the following key tips on what to legally consider when going through a divorce so that you can live the single life without any hassle:
You might want to hire a private investigator to check on your now ex-spouse.
It might sound to you at first as if you’ll be committing an invasion of privacy against your ex-spouse by hiring someone to snoop on them. But private investigation during a divorce can help you more easily discover if your ex-spouse is up to something that can negatively affect the outcome of your case.
The private investigator that you’ll be hiring to check on your ex-spouse would be on the lookout if they had some hidden bank accounts that you didn’t know about at all when you were still married to them, abusing any children that you have with them, and other instances of misrepresentation on their end.
However, when thinking whether to hire a private investigator to check on your ex-spouse, you should first seek counsel from your lawyer who’s helping you out with your divorce case.
You should simply accept your lawyer’s advice if ever they talk you out of hiring a private investigator if you only want to find out if your ex-spouse is currently seeing another person and it isn’t placing any significant negative impact at all on your children.
You’ll have to make compromises once you go through a divorce.
There are compromises that you have to make sooner or later over the course of your entire life. Some of those compromises you would have to make once you go through divorce by way of mediation.
There are two methods of negotiation that you, your ex-spouse, and your respective lawyers might use to try to come up with a fair and objective settlement, namely distributive and integrative bargaining.
If your lawyer has decided to proceed with negotiating the terms of your divorce with your ex-spouse’s lawyer using a distributive bargaining approach, you would want to think of it as similar to a contest or a game wherein there would always be a winner and a loser at the end of it all. Of course, you would want to be on the winner’s corner during the entire divorce process, especially if you’re the aggrieved party in your claim.
On the other hand, if your lawyer had used an integrative bargaining approach, they’re only making sure that both you and your ex-spouse would come to an amicable settlement where you’ve both gained some and lost some as a result of your divorce without resorting to any hard feelings towards each other. However, the integrative bargaining approach to settling a divorce through mediation typically applies only when there are too many issues left to resolve, but you and your ex-spouse have certain mutual interests that can be put to light when you talk them out in a room with your respective lawyers.
You can only start going on a date with another person once the judge who decided on your divorce case had signed the Final Order and Decree of Divorce.
Regardless if your divorce had undergone an out of court settlement or a full-scale trial, you would want to momentarily pump the brakes if you’re already starting to have romantic feelings for another person and wait for the Final Order and Decree of Divorce to be handed out.
If you’ve been seeing someone and the Final Order and Decree of Divorce legally terminating the marriage between you and your ex-spouse wasn’t granted yet, you may face adultery charges which can put you in unwanted legal trouble.
Other aspects of your divorce like the division of conjugal property, child support, and alimony may also be negatively affected when you see someone, and the judge who heard your case didn’t sign the Final Order and Decree of Divorce yet.
Even if some people might push you into dating someone despite your marriage with your ex-spouse still not yet legally terminated, you shouldn’t listen to them so that your entire divorce case wouldn’t get jeopardized. If you’re itching to start going back to the dating circuit once again, you should do so only if your divorce is already final.
Going through a divorce is no walk in the park. But as it may be the only solution left for you to end your increasingly toxic marriage with your spouse, you’ve decided to file it anyway. However, the entire divorce process doesn’t end with your marital ties to your now ex-spouse getting severed as they might retaliate against you anytime. Thus, you would want to read the above-listed tips on what you should consider from a legal point of view when going through a divorce, more of which you can obtain if you click here.
